What is a Limited Title boundary?

Having a Limited Title on your land can cause problems. A surveyor can help you get rid of the limitation and convert your land to a Torrens Title.

Before 1863, New South Wales had a complex system for land ownership. The old system was replaced the world-class ‘Torrens Title’ system.

A property with a Limited Title means it has not been fully defined by a survey and the boundaries have not been examined by Registrar General.

Having a Limited Title can cause the following problems:

  • Loss of land due to old fencing and buildings

  • Issues with finance. Many banks will not lend money on Limited Title land

  • A Strata Subdivision cannot be registered on Limited Title Land

  • Costly & stressful issues with neighbours or Council when building near the boundaries

You can remove a Limited Title by undertaking a ‘Plan of Delimitation’ with a Registered Surveyor. This process can take time to complete. Once lodged with Registrar General, it can multiple weeks, sometimes months, to be registered. The timing depends on your complexity of your site. Once registered, you will receive a brand new Title without the limitation.
